Yo-Ho Terms and Conditions

The following Terms and Conditions apply to Yo-Ho provision of long distance products and services and sets out the basic rights, obligations and limitations of Yo-Ho to its User (You, Customers, Subscribers or Purchaser). All of the terms and conditions contained herein “hereinafter referred to as "Terms "” bind both Yo-Ho and the User and are subject to change from time to time at the sole discretion of Yo-Ho, without prior notice to the User.

General
This is our agreement with you, the User. You agree not to use our Services for illegal purpose, violating any law, making annoying or offensive calls, or interfering with other customer’s service. You further agree not to resell, transfer, or share your service (s) without written consent of Yo-Ho.

Billing and Payment
User is responsible for paying all charges, plus all applicable taxes thereon, for the Services subscribed from Yo-Ho (which are subject to change from time to time at the sole discretion of Yo-Ho without notice to Subscriber).

Customer Confidentiality and Privacy
Before you begin to use our services, you will be asked to register to become a member. To complete the registration, you will need to give us some information about yourself including but not limited to your name, address, city, postal code and email address. Yo-Ho is collecting this information and we retain ownership of it. Yo-Ho believes that knowing more about you will enable us to serve you better. It also allows us to personalize the content and services we offer you.

Yo-Ho reserves the right to change or amend the Term and Conditions or policies regarding the use of the products or services at any time and to notify you by posting an updated version of the Term and Conditions on this Web site. The amended Terms and Conditions shall be effective immediately upon posting

Yo-Ho may terminate your access to any part or all of the products or services and any related service(s) at any time, if Yo-Ho decides in its sole and absolute discretion for any reason whatsoever. Yo-Ho total and absolute liability to the User will be to refund the unused cost of the products or services less any claim for set-off Yo-Ho may have against the User.

Customer or End User specifically agrees that Yo-Ho may access user’s account where necessary. It is Yo-Ho policy to respect the privacy of the User. Please see our Privacy Policy link for further information.

As a condition of your use of Yo-Ho products or services, the User will not use the products or services for any purpose that is unlawful or prohibited by these terms and
conditions. The products or services are provided for personal use only. Any unauthorized commercial use of the products or services, or the resale of the products or
Services, is expressly prohibited. The User also agrees to abide by all applicable local, provincial, federal, state, national and international laws and regulations and is solely responsible for all acts or omissions that occur under your account or password, including the content of your transmissions through the products or services used.

Customer shall defend and indemnify Yo-Ho, its parents, its employees, affiliates and agents from any claims, damages, losses or expenses (including without limitation legal fees and costs) incurred by Yo-Ho in connection with all law suits, judgments and causes of action for infringement of proprietary rights arising from combining with or using any device , system or service material transmitted by Customer over Yo-Ho Facilities; or injury, death or property damage arising in connection with the presence, use or non use of the Services or Devices.

Except as may be provided in this section, Yo-Ho, its managers, affiliates, employees, contractors or agents shall not be liable to customer, to any end user or to any other person for any damages or losses including, without limitations, property damage, loss of data, losses resulting from a third party’s unauthorized access to data, loss of profit, loss of earnings, loss of business and business opportunity, personal injury, death or any other damage or loss however caused, resulting directly or indirectly in connection with the terms and conditions herein, and the services, devices, other equipment, Third Party Services, Yo-Ho’s other facilities or the customer’s system, including any roaming calls or from the use of the Yo-Ho facilities by other telecommunication’s carriers, any acts of omissions of a Telecommunications carrier whose facilities are used to establish connections, defamation or copyright infringement that results from materials transmitted or received over Yo-Ho’s facilities, infringement of Patent arising from combining or using customer’s own facilities with the Yo-Ho’s facilities.

Customer acknowledges and agrees that the services and all devices and other third party services are provided by Yo-Ho “as is” and without limiting the generality of forgoing, Yo-Ho shall have no liability whatsoever to customer or end user for (a) distribution, advertisement or sale of Yo-Ho products and services through affiliates (b) any interruption or disruption of the services, the internet or disruption of third party services, or any damages suffered by customers which are caused directly or indirectly by any failure of the devices, other equipment, services, Yo-Ho’s other facilities, the internet and other the third party services, (c) any power failures, (d) any acts or omissions of the customer including without limitation defamation or copyright infringement, (e) any disruption of the any part of the equipment used to provide the services by parties other then Yo-Ho, (f) any intellectual property right arising from or in connection with customer’s use of devices, other equipment, the services or the third party services and (g) any suspension or termination of the services.

The information and services included in, or available through the products or services provided may include inaccuracies or typographical errors. Changes are periodically made to the product or services, these terms and conditions or the products and services themselves. The User agrees to be bound to such change. Yo-Ho reserves the right at its sole discretion to amend or rectify the errors.

Easy Tone & Direct Dial Welcome Rate
It is user (s) responsibility to read, observe and understand the Terms and Conditions of the use of the product and service before use. The use of this product and service means the acceptance of all Terms and Conditions by the user (s).

Welcome Rate Planis a 30 days promotional offer, for new customers and those who have not used this service for the past 6 months, calling long distance from a local access number. This offer cannot be combined and/or transferred to any other Yo-Ho products and services, long distance offers, promotions or discounts. Additional charges apply when using Toll Free access number, payphone or calling overseas cellular, premium and audio text services.

Regular Rate will apply after first 30 promotional days ends. Rates are subject to change from time to time without prior notice at sole discretion of Yo-Ho and are subject to applicable taxes.

User (s) shall not use, distribute to, or otherwise disseminate through Yo-Ho material or information of any kind that is libelous, defamatory, obscene, abusive, or otherwise violates any law or infringes or violates any rights of any other person, entity or goods and services.

Customer agrees that; Yo-Ho is not liable for:
a) Libel, slander, defamation or infringement of copyright arising from material or messages transmitted over Yo-Ho’s Network from Customers property or recorded by customers or other companies equipments.

b) Damages arising out of Customer’s transmission of material or messages over Yo-Ho’s Network on Customer’s behalf which is in any way unlawful.

c) Any act, omission or negligence of other companies, telecommunications system when their facilities are used in establishing connection to or from Customer’s facilities and equipment.

In addition, Customer acknowledges and agrees that Customer is solely responsible for taking the necessary steps and precautions to protect its network, software, data, files, devices and equipments against unauthorized access by employees and outsiders, and that responsibility includes, without limitation, protection against unauthorized access through product and services. Yo-Ho will not be liable for any claims, losses, actions damages, suits or proceedings resulting or otherwise relating to Customer’s failure to take appropriate precautions to protect its networks and systems and all software, data, files equipment and material, or against any breach of customer’s security or privacy whatsoever caused.

Yo-Ho may suspend or cancel any or all of its Services (s) without notice if
A. User does not follow this agreement as it may be revised or updated and after it was posted by Yo-Ho on its website.
B. Yo-Ho suspects that one or more of the lines of the products or services is subject to fraud or unlawful or improper use.
C. User uses the Services or Yo-Ho’s facilities fraudulently, unlawfully or improperly or in a way that adversely effect Yo-Ho’s operation or the use of Services by other customers
D. Customer provides Yo-Ho false, inaccurate or misleading information.
E. Customer seeks to unlawfully, fraudulently or improperly pay for product or service of Yo-Ho.
F. Yo-Ho may cancel any account or Services without notice if customer defaults on any prior agreements.

Smart Out Going Unlimited: The following terms and conditions apply to Yo-Ho provision of Smart Out Going Unlimited service and sets out the basic rights, obligations and limitations of Yo-Ho to its User (s). All of the terms and conditions contained herein are binding both Yo-Ho and the User (s) and are subject to change from time to time at the sole discretion of Yo-Ho without prior notice to the User (s). The amended Terms and Conditions shall be effective immediately upon posting on the web.

It is user's Responsibility to read, observe and understand these Terms and Conditions of use of product and service before use. The use of this product and service means the acceptance of all Terms and Conditions by the user. It's user's responsibility to observe the expiry date information on the product. The information and services included in may include inaccuracies or typographical errors. Changes are periodically made to the product or services and to the Terms and Conditions.

This service can only be used from one phone number. User (s) must have subscribed to caller ID from telephone service provider in order to use this service. For user convenience enter pin number first time only. These products are non refundable, non transferable, none exchangeable and liabilities are limited to the face value of the product only. Product will be activated once pin is scratched or revealed. Not responsible for service interruption or disconnection which may cause any loss to the user.

User (s) can use this service for cellular phone to convert limited outgoing minutes into unlimited incoming calls. This product and service is for local call use only. The long distance service feature is for promotional purpose only and is excluded as part of the service of the Smart Out Going Unlimited.

Long distance service of Smart Out Going Unlimited is for personal use only, and is not intended to be used for calls to a business, call to a cellular phone, call conferencing, call forwarding, 3 way calling or commercial use. The promotional offer of long distance service may be cancelled at any time without prior notice to customer with no liability to Yo-Ho.

This product and service is not intended for resale, violating any law, making annoying or offensive calls, or interfering with other customers service, sharing with other person, call conferencing, call forwarding, 3 way calling or commercial use. Any unauthorized or unlawful use of this product and service will result in cancellation of the service without prior notice.

Cell phone users are responsible for the Air time and to observe roaming charges charged by telephone service provider should user use this service from outside local calling area. It's User (s) responsibility to pay any amount owing to Cell phone service provider as result of excessive air time and/or roaming charges charged by the use of this product. For more information regarding roaming and free incoming calls contact your service provider.

This service cannot be used from a telephone if you are already using other services such as Direct Dial and Talk Unlimited from Yo-Ho on the phone.

Definition of some main words:

1. We (us), means Yo-Ho and its employees.
2. User, means you, customer, subscriber, purchaser or anyone who uses the products and services of Yo-Ho including affiliates and employees.
3. Services, means all services provided through Yo-Ho Network including long distance service such as Easy Tone and IP Phone services.
4. Product, means all products provided Through Yo-Ho Network including calling card, Portable Phone, Direct Dial vouchers and Unlimited long distance cards.
5. Affiliate, means associates, partners and agents. People who collectively work with Yo-Ho to sell, market, advertise and promote Yo-Ho’s product and services.
6. Unlawful, means illegal activities by User (s) over Yo-Ho network.
